>> good morning and thanks for being with us. it's 5:01. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. good morning. we can tell you there is a major problem solved in oakland now, we now know what's causing major glitches in the city's multi-million-dollar police radio system. that's good news for everybody. christie smith is live in observe land and christie, the city is pointing its finger straight at at&t. >> reporter: that's right. oakland is saying after looking into this for a while they think they have got at any the problem nailed down that it's at&t's 2g network. sometimes the radios don't even work in the basement of old p.d.'s head quarter. the radios don't work. for patrol officers they say that this radio system is really putting them in danger.

officers have been unable to connect with dispatchers or talk with each other on the radio. the radios often don't work in buildings around town. oakland confirmed the issue. here is one example after close call days ago. >> the vehicle they were chasing crashed, he called in a car accident, then the suspect and fought the officers, the officer got on the radio to inform dispatch and what was going on. he was transmitting but he couldn't hear. >> reporter: at&t is cooperating and said in a statement in the interest of public safety and as a cautionary measure we're looking into the matter, we have temporarily taken some 2g frequencies out of service at some cell sites in oakland. at&t is still running 3g and 4g service and 2g on another frequency. this should have minimal impact. the city of oakland is looking

at other service providers to see if there is interference there. >> thousands of people in northern california are waiting out a wild fire that continues to threaten their homes. the fast-moving ponderosa fire began saturday sparked by lightning, it has burned more than 23 square miles in shasta and da hema county. the fire is threatening 3500 more homes and forced thousands to evacuate. dozens of roads have been closed causing confusion for many trying to leave the area. firefighters say the fire is only about 30% contained. >> in a case that will impact any one who owns or will purchase a smart phone or tablet t lawsuit continues with closing arguments and it does look like despite an attempt by the judge to resolve this differently it woyl be handed over to a jury. why even if you don't have an apple or samsung product this

will affect you. good morning. >> reporter: good morning to you. heading into the final hours of the trial, the judge here had asked the ceos of both companies to talk and see if they could come to a resolution. the talks failed so it is up to a jury to decide and figure it all out. apple claims their phone was copied and an injunction that would bar samsung from selling the galaxy. experts say if apple wins other companies have to come up with unique features to dwbs their phones. if samsung wins, it may test the limit of what patents can cover. that ultimately this will be

before the dotcom bust. though if you look, you use 2012 dollars microsoft worth more like $850 billion back in the day. >> remember last week we talked about, what, we talked about the end of the facebook lockup where original investors could sell shares of facebook. we said it would be some time before we knew who exactly sold. now we know this man, peter teal sold. he was one of the original founders of paypal invested in facebook, sold 20 million shares of facebook. this gives him about 5 million shares remaining. let's check the rest of the news before the bell. good morning, jackie. >> good morning, scott. the futures are pointing to a slightly higher open this morning after stocks pared losses on monday. the dow continues its down trend on monday closing in the red, 15

of the past 17 mondays. investors will watch for tomorrow's release of minutes from the fed meeting and today we're going to get earnings from best buy, barnes and noble and dell. we saw the dow falling to close at 13,271, the nasdaq slipping to 3,076. and nike is laying out new rules for retailers that sell its shoes. "the wall street journal" reporting that the company told stores they will no longer be able to presell or take reservations for new shoes. the move is part of nike's effort to beef uf safety for stores and consumers prompted by the sometimes unruly crowds that line up for expensive shoes. back over to you. >> i'll keep wearing the same pair i have for the last four years. they probably do need an update. >> all right, scott. >> even with the old shoes you are very nimble on your feet. always looks good. >> scott be nimble scott be

quick. >> scott check the nasdaq and come back. good morning to you. we've got a good looking forecast shaping up today. i was a little late because i had to check on the wind. you know, so many of the world's top sailors in town, the fastest boats out on the bay. we're going to have a live report from our own bob redell coming up. but i'm really concerned about where our winds are headed. so let's get to that. we're in the mid-50s today. throughout day here's your futurecast for winds. you can see they are going to pick up throughout the day. you see the yellow, the orange, that's the high end of the key so getting some pretty gusty winds in addition to some strong sustained wind speeds over our bay. so that will come into play for the races. which always makes at little more interesting. low pressure is going to keep us cool. just about every single day this week at the coast, over the bay. however, a little hot inland today.

89 degrees today in livermore. cooler through your wednesday. today's highs work like this. around 79 degrees in san jose, 79 in los gatos and 70 in santa cruz, holding on to mid-80s through the weekend. let's see what we're holding onto in the traffic department. >> unfortunately someone was driving fast but i can't say that for sure. i know they went off of the roadway and did run into this power pole here. and that is what caused this deadly accident that we continue to follow. speeds southbound the commute direction are okay. but northbound you do see speeds dip because you lose one of your two lanes traveling north. pg&e is on the scene and there is an investigation adding to the çslowdown. add two or three minutes and you should be okay now north of highway 37 north past atherton avenue. the east bay, more slowing, this is westbound 580, that shows early slowing toward the dublin

interchange. this closure is because of eastbound 580 transitioning onto 680. so both directions not what we're looking at as far as a slowdown. there are no incidents through dublin or pleasanton. the slowing out of the altamont pass in toward livermore in the westbound commute direction. as we move south, typical commute. a live look at san jose, 101, the volume of traffic under the interchange so there is your northbound route. that is the commute direction. up the peninsula, 101, here in palo alto, easy light flow past university avenue into the city a. nice drive along the peninsula. >> mike, thanks. >> it's 5:18 f. you are a racing fan of the sailing type today is the day. the america's cup world series qualifying races today in san francisco. that goes off 18 few hours. our man on the scene "today in

the bay's" bob redell there with all of the pre-race festivities and preview. what's going on, bob? >> reporter: good morning to you, jon. you're talking about eight teams, 11 boats on the bay all week long. this is season two of the world series of the america's cup, like an appetizer if you will for the main event coming back here to san francisco next year. good morning. thanks for joining us this morning with america's cup. we're in the digital boat house. this is going to be running all week. what can fans expect? >> it's the most advanced technology brought together to engage the fans into this new exciting america's cup. and really engage the people not sure up to eight speeds of different cameras out on the water. two cameras on each boat. this is obviously you can't be on the water wind chilling. you have to come to the shore.

here you see the footage? >> right. there are eight feeds, two cameras on board each boat. audio, a viewer can come in learn in how to sail but at the same time see the fastest and best in the world. >> you're a sailor. the bay area, from your point of view, how is this? >> the bay area is going to be the most difficult sailing these guys are going to see. it's really windy here, the direction is such they will be next to the shore. and it's an interesting fact in the bay is very strong current. that causes sometimes the trough to lift up or flatten off. you'll see big incidents i'm sure. >> ac 45. catamarans, they are not going to be slow. how fast are these? >> you can expect to see most of the boats traveling at 30 miles per hour most of the time. which is like equal probably

>> welcome back. here is something that will make you want to get out of bed. a 14-year-old swimmer from canada now the youngest person to swim across lake ontario. analice car finished all the way over in toronto, about 32 miles away. it's more than that. the 14-year-old was allowed to takeç breaks to eat but she always remained in the water. of course she had to fight the cold temperatures and the high waves but she says it was worth it. >> saw everyone waiting for me and giving me hugs. they knew i could do it the whole time so it made me feel really good. >> as you should, young lady. carr says she did this to make the record books and she wanted

to raise money for children with cancer. >> wonderful young girl. >> very proud of her. >> meteorologist christina loren, she is tracking the bay area forecast. a foggy start in san francisco. >> yeah, you know what, that's pretty usual for this time of the year. that's what's going to keep our temperatures cooler, the natural ac off the pacific. we're not going to have to deal with the low clouds for long. they should burn off by 10:00. by noon a mix of sun and clouds, 78 degrees inland, 89 in the heat of the day even in livermore. so we're talking about the extreme cities only reaching 89. 76 bay side and 65 degrees at the coast. we do have changes on the way. no significant changes, but moderate changes that you might have to go ahead and change your lifestyle for. we're going to talk about that. if you live near the coast, stay tuned. let's check your drive headed into san jose or out. mike has the details. >> i'm going to take to you the east bay, the maze and we'll

look at a flow of traffic starting to build a tad bit. no major slowing. i want to report this incident on the incline. a disabled vehicle up that westbound commute direction toward treasure island but a quick look at the toll plaza and it will see a smooth drive at the toll plaza from the oakland side into the city. no metering lights. we'll track this and let you know if it affects the oakland departure. looking from another bridge, westbound with the taillights away from us, a smooth drive. the headlights toward us are blurring not because of fog but the smeary lens. we continue to have an issue for that. that's our own housekeeping issue. >> we need some windex. >> 5:26. london glowing after all of the action there but this one may not be an olympic sport but a race is drawing a lot of spectators. >> hundreds turned out for the world folding bike championship.

750 competitors battled it out for the fastest. riders tackled the 4-mile course twice. the racers began running to their bikes, unfolding them and jumping on to finish the course. in a very british twist they banned spandex and any other supporting asire stating racers had to dress smartly. >> can't say i argue with the spandex twist. still to come, a different approach to craigslist sales. police are offering their buildings. >> can you hear me now? police say they found the culprit behind radio glitches, how they are dealing with the problem.

closing arguments are set to begin in the lawsuit between apple and samsung. >> we have team coverage in place this morning. scott mcgrew is here to explain the impact this could have on future mobile devices. we start with stephanie chuang with all of the latest on this case. good morning. >> reporter: good morning, jon and marla. there was an 11th hour attempt to resolve this. the judge asked the ceos of both companies to talk and see if they could come wake-up some sort of resolution. yesterday those talks failed. so this indeed will be up to a jury to decide. the outcome of this case will be impacting the market of smart phones and tablets even if they are not apple samsung products. apple claims 20 infringed on its patents seeking $2.5 billion in damages as well as an injunction to bar samsung. samsung charged apple infringed

on its patents. no matter what kind of smart phone or tablet you own, the outcome will impact you though probably not the device you own now. >> nothing is really going to happen. this is a war being fought by two titans and they are not going to get stepped on, no one's going to come in and take the phone. no one's going to stop supporting it. this will get worked out. >> reporter: the jury will likely begin deliberations tomorrow with a 22-page verdict form that has 36 questions the jurors must decide upon. both sides get two hours for closing arguments today and that's set to begin at 8:30 this morning. stephanie chuang, "today in the bay." >> scott continues our coverage. you head down to the court and guess says you don't envy the jury. >> no. we watched experts tell the jury that samsung copied apple. we watched experts say they

didn't copy apple. these experts, they are college professors, engineers and paid for by apple or samsung but they believe what they say. so if the experts can't agree, one wonders how a jury is going to come up with one thingle opinion. stephanie mentioned dozens of phones, did the samsung mesmerize copiy apple. can you tell them apart. let's assume they do rule for apple. they have to decide how much it's worth. did it cost $20 million in damage, i'm making these up, did it cost $200,000 million in damages. it's one of the reasons that lucy coe warned both sides nobody is going to be happy with what the jury decides. it's going to be a tough decision, marla, for the jury

phone by phone and damage by damage by damage. who don't have expertise. >> complicated and interesting. oakland pleas may know the cause of their radio communication problems. police have been complaining about dead spots in the system since it was infalled over a year ago. the at&t network is interfering. when officers get too close the radio goes dead. >> our channels are very close to that channels that are in the spectrum and they are just leading over into our channels. >> at&t says it's taking some 2g frequencies out while it looks into the matter. at&t says it does not expect customers to be impacted. >> santa rosa police dispatch is back on line. officers were unable to answer

emergency calls after a blown circuit bone caused a power outage. in minutes calls were rerouted. a spokeswoman for the police department says the circuit board has been replaced and regular service is up and running. police investigating two more shootings. one killed a man last night, that's near king and story road. it's the city's 29th homicide of the year. the second shooting happened about 30 minutes later at jackson and luz avenue. that victim is expected to survive. no word on what the shootings are connected. >> bay area law enforcement agencies may have found a way for people to avoid becoming the next victim after craiglist robbery. the sheriff's department is

>> we begin with decision 2012. more fallout from congressman todd akin's controversial comments about legitimate rape. he is fighting to stay in the race for the senate seat in missouri despite plummeting support. claire leka is live with the big decision he has to make today. good morning. >> good morning to you, marla. and republican congressman todd akin releasing a television ad this morning apologizing for those legitimate rape comments, asking for forgiveness from the missouri voters. he's also saying that he used the wrong word in the wrong way. now, he has a deadline that is ticking down right now, a deadline for him to withdraw from the senate race in missouri. it's 5:00 p.m., that is the deadline. the second deadline he could withdraw by court order, that would be on or before september 25th. democrats are pouncing on this

latest republican misstep. president obama is trying to draw a stark line between women's issues of his party and the gop party. he went after akin's comments in a press conference yesterday at the white house, denouncing them. also, gop presidential candidate mitt romney trying to distance himself and his ticket as far away as possible from akin's comments saying they were deeply offensive. and even republican party leaders are calling on akin to step down. senate minority leader mitch mcconnell basically saying that also the gop pulling $5 million of funding from his senate campaign. we're live in washington. claire leka. marla, back to you. >> thanks so much. >> it's 5:43 now. how about this. choppy waters, gusty winds going to be an intense day on the bay for sailors taking part in the america's up qualifying heat.

>> bob spoke with one of the sailors, now live in san francisco with a preview. good morning. >> reporter: good morning to you. we're here at the america's cup village that popped up, opening up officially at 4:30 today. 10:00 each day after for the america's cup world series taking place this week here in the bay and they will sail on boats like these, 45 foot long catamaran. this does not have its soft sails up. not competing this week but familiar with this kind of racing. i'm curious t boats get up at an angle. this would be extreme, i assume? >> this is probably more than they want. you get nervous. i know the guys are going to get nervous. >> you don't want to tip over. i guess from a fan point of view seeing them get up like that is so dramatic. what can you tell the people

here, what would they expect this week? >> it's new to have the cat ma rans, but now two hulls, they are a lot faster so you can expect to see in the san francisco event these boats going very fast and also being very hard to control and handle by the crew. you can see it looks complicated and for the guys on the board when they are racing with lots of wind, tough conditions. i'm expecting capsizes and crashes. >> generally, are they -- is it like the blue angels they are so close? >> there are rules of the road and the boats will be so close without breaking rules. if they touch the rules break. it gets that close so. they break the rules and they crash into each other now and

is usually something we frown on. because of the race we're excited about it. yesterday we had calm winds, if it was yesterday it wouldn't be quite as exciting. you can see right now not a lot. we have thick low clouds this morning but you can vaguely at the bottom of your screen see a little light coming through the clouds. they will burn off in the city by about noon. we'll take a closer look at your america's cup forecast coming up. right now i want to start with current conditions. 50 in novato. 55 in san francisco. 57 in san jose. high pressure still kind of in control, but it's being pushed off to the east as an area of low pressure digs south. for us this is what's keeping us cool at the coastline bringing in low clouds. we have drizzle this morning. especially over the bay. keep that in mind. it's going to be cooler, tomorrow we'll cool you off with
